The term of a provisional patent is one year during which time you (or your assignee) must file for a regular patent or you lose the advantage you get from obtaining a provisional patent.
With the protection of the provisional patent, you can reveal the secrets of
your idea to prospective purchasers. You will want to have several companies or people with good resources bidding for the rights to your invention and, when you sell to the highest bidder, THEY will pay for the regular patent filing
and you bank the cash. Then you will sit back and collect royalties later as
your invention sells.
So, how do you get a provisional patent? You can go to the USPTO web site at www.uspto.gov and sort through all the forms they have and figure out what to do yourself. That will probably take about 20-30 hours of research. You will have to decide if you have that much time to devote to the effort. If you do, go the the web site named above and get going.
You could also hire someone to fill in the forms for you. There are some web sites that allow you to fill in the form information on-line and, when you pay the fee (usually about $80-$120), they will submit your application for you.
You could hire a lawyer to do it for you but expect to pay around $1,500+ for
such service. Or you could buy a kit that has all the forms and instructions for a nominal fee. The best kits don’t limit the number of times you can apply.
There are no guarantees but the best bet is to use a kit that someone else has used successfully. Google “provisional patent kit” and look at the choices. Review what you get and the price. You’ll find a good deal and you will be well on your way to getting your provisional patent.
